Terms and Conditions

These Terms and Conditions govern the use of the website and any purchases made through www.themelonexplorer.com.  By placing an order, you agree to these terms. We recommend saving or printing them for future reference.

1. Definitions

  • Customer: Any individual who places an order or enters into an agreement with the Company.

  • Agreement: Any order, arrangement, or contract between The Melon Explorer and the Customer, including these general terms and conditions, where applicable.

  • Website: www.themelonexplorer.com and its subdomains.

2. Scope of Apllication

These Terms and Conditions apply to all offers, orders, and agreements made by the Company unless expressly agreed otherwise in writing.
Any different conditions proposed by the Customer are not binding unless accepted in writing.

3. Prices and Payment

  • All listed prices include applicable taxes unless stated otherwise.

  • Shipping costs will be clearly displayed before completing the purchase.

  • Payment must be made in advance through the payment methods available on the Website.

4. Orders and Delivery

  • An Agreement is formed once the order has been confirmed and payment received.

  • Products will be shipped to the address provided by the Customer within the estimated delivery time.

  • If a delay occurs, the Customer will be informed and may choose to cancel the order.

  • Risk transfers to the Customer once the package has been delivered.

5. Right of Withdrawal

  • The Customer may return the product within 14 calendar days of receipt, without giving any reason.

  • The product must be returned in its original condition, with accessories and packaging when possible.

  • Return shipping costs are borne by the Customer unless the item is defective or incorrect.

  • Once the product is received, a refund will be issued within 14 days using the original payment method.

6. Warranty and Complaints

  • All products are covered by the applicable legal warranty.

  • Any defects must be reported in writing within 2 months of discovery.

  • If the claim is valid, the product will be repaired, replaced, or refunded up to the amount paid.

7. Force Majeure

The Company is not liable for delays or non-performance caused by circumstances beyond its reasonable control, such as strikes, transport issues, or natural disasters.

8. Data Protection

Personal data will be processed in accordance with the Privacy Policy available on the Website.
Customer information will only be shared with third parties when necessary to process orders or comply with legal obligations.

9. Liability

The Company makes reasonable efforts to ensure the availability and correctness of the Website content but does not guarantee uninterrupted access or absence of errors.
The Company shall not be liable for any damages arising from:

  • Interruptions, interferences, or disconnections caused by factors beyond the Company’s control.

  • Computer attacks, viruses, or other harmful elements that may affect the Customer’s systems.

  • Improper use of the Website or failure to comply with these Terms and Conditions.

10. Right of Exclusion

  • The Melon Explorer reserves the right to deny or withdraw access to the Website and/or its services, without prior notice, at its discretion or at the request of third parties, for users who breach these Terms and Conditions.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of Germany.
Any dispute shall be submitted to the competent courts of the jurisdiction where the Company is established.
If any clause is deemed invalid, the remaining provisions shall remain in effect.
“Written communication” also includes email correspondence.
